# Do you need a permit to replace a garage door?

> It depends on who issues permits at your address. Here's what each Delaware town, county and Eastern Shore office says.

## The short answer

It depends on who issues permits for your address: the city or town inside its limits, the county outside them, and in parts of Sussex County, both. The City of Dover's permit brochure lists windows and exterior doors as work that needs a building permit, while Sussex County's list says replacing existing exterior doors needs no county permit, though towns can require their own. Historic districts, HOAs and town business licenses add steps, so call the office before you order.

## Who issues the permit for your address?

The government that covers the land under the house. Inside an incorporated city or town, its office issues the permit and its rules apply; outside town limits, the county's office does. Some places split the work: Felton issues a zoning letter and Kent County issues the permit, several Sussex towns leave plan review and inspections to the county, and in Sussex a job can need both a town permit and a county permit.

A mailing address doesn't settle it. The Townsend 19734 ZIP covers about 80 square miles around a town of about 1 square mile, and the 19803 and 19810 ZIPs north of Wilmington lie almost entirely in unincorporated New Castle County. Beyond the permit itself, watch for historic district review, HOA approval, a town business license for the contractor, and flood-zone rules.

## Who issues permits in Kent County?

Kent County issues building permits outside town limits, and of the Kent towns below, all but Felton issue their own. The county enforces the 2018 IRC with county amendments and says permits are required for any work in flood plain areas.

- Dover: City of Dover Department of Planning and Inspections. The city's permit brochure lists windows and exterior doors among work that needs a building permit, and in the Historic District Zone, Architectural Review Certification is part of the permit. (302) 736-7010.
- Camden: Town of Camden. Town Hall, not Kent County, handles permits in town, and its residential form covers exterior renovations and garages. (302) 697-2299.
- Wyoming: Town of Wyoming. The town issues its own permits under the 2018 IRC; its list covers detached garages, pole buildings and windows, and the application asks for HOA approval where there is one. (302) 697-2966.
- Smyrna: Town of Smyrna Building and Inspections. The permit list includes windows, doors, garages and pole barns, and work in the historic district also goes to the Historic District Review Board. (302) 653-3486.
- Clayton: Town of Clayton. The town issues its own permits, Kent County issues none in town, and plan review can take up to ten business days. (302) 653-5637.
- Felton: Town of Felton, then Kent County Inspections and Enforcement. The town issues a zoning Compliance Letter, and the county issues the building permit. (302) 284-9365.
- Harrington: City of Harrington Planning and Inspections Department. City Hall at 106 Dorman Street issues permits, and Kent County's list says no separate county permit is needed. (302) 398-3530.
- Milford: City of Milford Building Inspections and Permitting Division. Its FAQ says garages, roofs and siding need permits and tells owners to check HOA requirements; for Sussex-side work, the city says to ask Sussex County about a county permit.

## Who issues permits in New Castle County?

New Castle County's Department of Land Use issues building permits outside the incorporated cities and towns.

- Bear, Glasgow, Hockessin, Pike Creek and Pike Creek Valley: New Castle County Department of Land Use, 87 Reads Way, New Castle, (302) 395-5400. None is an incorporated town, so a Newark, Wilmington or Hockessin mailing address doesn't change who issues the permit, and HOA approval is a separate step.
- Middletown: Town of Middletown Permits, Licensing & Inspections. The permit list covers garages and changes to wall openings or electrical circuits, and a town permit pack warns that HOAs may require approval of exterior changes. (302) 378-1171.
- Townsend: Town of Townsend Town Hall. Inside town limits, the January 2026 application requires compliance with HOA or maintenance corporation deed restrictions before you apply, and electrical permits come from the State. (302) 378-8082.
- New Castle: City of New Castle Building Department and Historic Area Commission. In the historic district, every exterior change needs a Historic Review Certificate on top of any building permit, filed at least 15 days before the commission's monthly meeting. (302) 322-9813.
- Newark: City of Newark Code Enforcement Division. The permit list doesn't name garage door replacement but covers garages, changes to wall openings and new electrical circuits, and leased houses need a yearly city rental permit. (302) 366-7000.
- Wilmington: City of Wilmington Department of Land Use & Planning, 800 N. French Street. Exterior changes in the city's historic districts and its conservation district go through the Design Review and Preservation Commission. (302) 576-3050.

## Who issues permits in Sussex County?

Sussex County and its incorporated towns both issue permits, and the county's own list puts replacement of existing interior or exterior doors among projects that need no county permit. The list doesn't single out garage doors. It does require county permits for detached garages, pole buildings, additions and exterior renovations, and it says properties inside a town may need additional permits from the town. The county's Building Permit Section answers at (302) 855-7720.

- Lewes: City of Lewes Building Department. The city issues its own permits, every business working in town needs a city business license, and street-visible exterior changes in the Historic District go through the Historic Preservation Architectural Review Commission (HPARC).
- Rehoboth Beach: City of Rehoboth Beach Building & Licensing. Permits cover construction, remodeling and additions in city limits, with no construction on Sundays, holidays or Saturdays from May 1 to October 31.
- Dewey Beach: Town of Dewey Beach Building Department. Work from $1,000 to under $10,000 needs a Notification of Work and $10,000 or more a building permit, each filed with the contract or estimate, and contractors need a Dewey business license.
- Bethany Beach: Town of Bethany Beach Building Department. The permit page names new structures, repairs to damaged structures and certain equipment, not garage doors, and about 80 percent of town is in the mapped floodplain.
- Ocean View: Town of Ocean View Planning, Zoning & Development. Town permits call for HOA or development approval where it applies and a town business license for every contractor and subcontractor, with plans also sent to Sussex County.
- Millville: Town of Millville Facilities and Building Department. Applications include any required county permit and an HOA letter in HOA communities, contractors need a town business license, and fees double if work starts before a required permit is issued.
- Fenwick Island: Town of Fenwick Island Building Official. Permits cover work inside town limits only, the official enforces the floodplain rules, and construction is barred on Sundays, major holidays and Saturdays from May 15 to September 15.
- Selbyville: Town of Selbyville. Permits need an HOA letter where one applies and the contractor's town business license, and Historic District changes need a Certificate of Approval with a sample of every material.
- Milton: Town of Milton Planning and Code Enforcement. In the historic district, exterior changes need Historic Preservation Commission approval first, with paint color the one listed exception.
- Georgetown: Town of Georgetown, with Sussex County plan review and inspections. The town's guide says repairing or renovating a structure needs a permit, citing replacement windows and siding, and contractors need a town business license.
- Millsboro: Town of Millsboro Building Department. The town issues permits under the 2021 IRC for altering or repairing a one- or two-family home or townhome.
- Dagsboro: Town of Dagsboro, with Sussex County plan review and inspections. The residential application lists replacement and garage work among its project types and asks for the contractor's town and state business license numbers.
- Seaford: City of Seaford Code Department. The city issues residential permits under the 2021 IRC and lists siding, sheds and fences among jobs that need one.
- Laurel: Town of Laurel Planning and Code Enforcement. Permit and inspection questions go to the Director of Code Enforcement at (302) 875-2277.
- Bridgeville: Town of Bridgeville, with Sussex County plan review and inspections. The application asks Heritage Shores owners whether HOA approval is in hand and says to check whether the county also needs a permit.
- Greenwood: Town of Greenwood, with Sussex County plan review and inspections. Town Hall checks whether the address is in a flood zone and requires the builder to hold a Greenwood business license.
- Delmar: Town of Delmar Code Enforcement. One office serves the Delaware and Maryland sides, and a detached garage 14 by 14 feet or larger goes to the joint Planning and Zoning Commission.

## How do permits work on Maryland's Eastern Shore?

Maryland counties, and some towns, run their own permit offices under the state's 2021 codes, which took effect May 29, 2023, with local enforcement required by May 29, 2024. The Maryland Manual lists the permit office for each county.

- Caroline County: Department of Planning & Codes, 403 South 7th Street, Suite 210, Denton, with online permit applications.
- Worcester County, outside Ocean City: Department of Development Review & Permitting, 1 W. Market Street, Snow Hill, (410) 632-1200. Its 2024 amendments exempt detached garages under 500 square feet from construction-plan submission, though a permit may still be required.
- Ocean City: Town of Ocean City. The town says its code requires a building permit for nearly all construction, structural repair work and placement of accessory structures.
- Cecil, Kent, Queen Anne's, Talbot, Dorchester, Wicomico and Somerset counties: each runs its own permit office, listed in the Maryland Manual.

## What should you do before you order a door?

Call the office for your address, and treat this page as a map of who to ask, not a ruling on your job. These notes come from each office's own pages and forms as of October 2026, and forms, fees and ordinances change. Get any HOA or historic approval in writing before you order. When we measure for a new door, we ask about permits and HOA rules too.

On a garage in a flood zone, add a call to the floodplain administrator. Kent County requires permits for any work in flood plain areas, and FEMA warns that later owners sometimes replace vented garage doors with solid ones by mistake, which can undo the garage's flood openings.

## Questions

### Do I need a permit to replace a garage door in Dover?

Plan on asking for one. The City of Dover's permit brochure lists windows and exterior doors among the work that needs a building permit, and Planning and Inspections at City Hall, 15 Loockerman Plaza, takes questions at (302) 736-7010. In the Historic District Zone, Architectural Review Certification is part of the building permit, so talk to the city about the door's style before you order.

### Does Sussex County require a permit to replace a garage door?

Not the county, for a straight swap. Sussex County's permitting list puts replacement of existing interior or exterior doors among projects that need no county permit, though it doesn't single out garage doors. The same list says towns may require their own permits, and Millville, Ocean View and other towns have their own rules. A new detached garage, a pole building or a renovation does need a county permit.

### Do I need a permit to install a garage door opener?

It depends on the wiring. Middletown and Newark list new electrical circuits among the work that needs a permit, Townsend says electrical permits come from the State, and Sussex County's list puts electrical work among projects that need no county permit. If the opener plugs into an outlet that's already there, ask your town whether anything is needed; if the job adds a circuit, ask who issues the electrical permit before work starts.

### Does my HOA have to approve a new garage door?

If you live in an HOA community, plan on it, and treat it as a separate step from the permit. Ocean View's checklist lists HOA or development approval where it applies, Millville and Selbyville want an HOA approval letter with the application, Townsend requires deed-restriction compliance before you apply, and Bridgeville's form asks Heritage Shores owners whether they have approval. Get the rules on style, color and windows in writing before you order.

### Who issues permits in Wilmington and New Castle County?

Inside Wilmington city limits, the Department of Land Use & Planning at 800 N. French Street issues building permits, and exterior changes in historic districts go to the Design Review and Preservation Commission. Outside the city and the county's other incorporated towns, New Castle County's Department of Land Use at 87 Reads Way handles permits. A Wilmington mailing address doesn't settle it: the 19803 and 19810 ZIPs lie almost entirely outside the city.
